Universal Terms of Sale & Limitation of Liability


1. Definitions and Scope

For the purposes of these Terms, "Products" shall refer to any and all goods sold by Bold Safety Company, now or in the future, including but not limited to hand protection, eye protection, respiratory equipment, fire-resistant apparel, tools, and any other personal protective equipment (PPE) or industrial supplies. These terms apply universally to all current and future inventory.

2. Nature of Hazards & No Guarantee of Safety

You acknowledge that the industrial environments for which these Products are intended (including but not limited to welding, construction, chemical handling, and heavy manufacturing) contain inherent, unavoidable, and unpredictable risks of serious bodily injury, permanent disability, and death.

  • No Immunity: You acknowledge that no piece of Personal Protective Equipment can offer complete protection from all injuries or hazards. The use of our Products cannot eliminate the risk of harm.

  • Suitability: Bold Safety Company does not warrant that any Product is fit for a specific purpose or specific hazard intensity. The determination of whether a Product is appropriate for a specific task rests solely with the Buyer and the End-User.

3. Voluntary Assumption of Risk (Strict Usage Clause)

BY PURCHASING AND USING THESE PRODUCTS, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOU ARE DOING SO ENTIRELY AT YOUR OWN RISK. You voluntarily assume all risks, known and unknown, associated with the use of these Products, including but not limited to:

  • Injuries resulting from the misuse, abuse, or modification of the Product.

  • Injuries resulting from the normal wear and tear or degradation of the Product over time.

  • Injuries resulting directly or indirectly from the correct and intended use of the Product (e.g., a burn occurring despite wearing heat-resistant gear, or impact injury despite wearing impact protection).

4. Absolute Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOLD SAFETY COMPANY SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER.

BOLD SAFETY COMPANY SPECIFICALLY DISCLAIMS ALL LIABILITY FOR:

  1. PERSONAL INJURY OR DEATH: ARISING FROM THE USE, MISUSE, OR FAILURE OF ANY PRODUCT.

  2. CONSEQUENTIAL DAMAGES: INCLUDING LOST PROFITS, STOPPAGE OF WORK, OR DAMAGE TO OTHER ASSETS.

  3. FAILURE TO PROTECT: ANY CLAIM THAT THE PRODUCT FAILED TO PREVENT INJURY, REGARDLESS OF WHETHER THE PRODUCT WAS USED IN ACCORDANCE WITH GUIDELINES.

IN NO EVENT SHALL BOLD SAFETY COMPANY'S AGGREGATE LIABILITY EXCEED THE ACTUAL AMOUNT PAID BY THE BUYER FOR THE SPECIFIC PRODUCT ALLEGED TO HAVE CAUSED THE DAMAGE. THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ASSERTED, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE.

5. Indemnification

You agree to indemnify, defend, and hold harmless Bold Safety Company, its owners, officers, and manufacturers from any and all claims, liabilities, damages, and costs (including legal fees) arising from the use of the Products by yourself, your employees, or any third party to whom you distributed the Products.
